Law change: It will now be legal for women to donate eggs to their partner
New agreement: Repeal of the ban on partner egg donation without a health-related justification
We continue in 2024 with another big news in the field of legal changes on assisted reproduction.
As the law stands today, it is not possible for a female couple to donate eggs to each other, unless there is a health-related reason. It has therefore not been possible in a woman-woman couple that one woman donated her eggs to the other woman, who subsequently carried the pregnancy ("shared motherhood"). The parliamentary parties have now reached an agreement to change the law so that "shared motherhood" becomes legal in Denmark.
Minister of Health Sophie Løhde says:
”We want to help women who are getting married start the family of their dreams. That is why I am happy that we have entered into a broad political agreement that will in future make it possible for all women who want to be pregnant with their partner's eggs to get help at private fertility clinics. Today, it only applies to women who cannot get pregnant. There must therefore be a health-related justification, but we are now changing that.”
Legalizing partner egg donation without health-related justification requires an amendment to the Assisted Reproduction Act. The parties to the agreement agree that efforts are being made to ensure that this change in law can enter into force as of 1 January 2025.
